Terms of Service

Draft — pending final counsel review. The substance below reflects how B/NG actually operates today. Material changes will be announced 30 days before they take effect.

These Terms govern your access to B/NG (“the platform”), operated by B/NG Media, Inc. By creating an account, submitting content, viewing, or paying any fee, you agree to these Terms.

1. Account types

B/NG supports four account types: viewer (free or B/NG Pass), creator (active monthly subscription required to publish), moderator, and admin. Founding Viewer and Founding Creator are lifetime grants tied to the underlying account type and are non-transferable.

2. Eligibility

  • You must be at least 13 years old to view, 18 to create or transact.
  • Accounts representing minor talent must declare it at submission and supply a parent/guardian release on request (BNG-21).
  • One account per natural person. Operating multiple creator accounts to circumvent strikes is grounds for immediate ban.

3. Content submitted to the platform

You retain full ownership of content you submit. By submitting, you grant B/NG a non-exclusive, worldwide, royalty-free license to host, transcode, transmit, cache, display, and stitch the platform end card onto your content for the purpose of operating B/NG. The end card is non-removable — every video that plays on the platform carries it.

We do not assume ownership, and we do not use your content to train third-party AI models without an explicit, separately-executed agreement.

4. Submission fee and creator subscription

  • $1.99 per series at submission. Non-refundable, including for rejections.
  • $0.99/month or $7.99/year creator subscription required to keep series published. Cancellation hides published content until subscription resumes.
  • Founding Creators are exempt from monthly fees forever, but still pay the per-series submission fee.

5. Moderation and strikes

Submitted content runs through automated moderation (text + frame scanning, music content ID, audience-rating validation). Auto-flagged content goes to human review with a 24-hour SLA. Final rejections are explained in writing.

First confirmed policy violation is a warning + content removal. Second is a 30-day submission suspension. Third is a permanent ban. A first submission that violates policy results in an immediate permanent ban — this is the activation gate. Appeals run through /account/strikes.

6. Payments

B/NG is the merchant of record for all transactions. Stripe Connect handles creator payouts. Tipping, fan subscriptions, and series unlocks transfer at T+2 business days. Ad revenue share is paid monthly in batch. Brand sponsorships transfer T+5 after B/NG receives brand payment. The full split table is published on the Rate Card.

Subscription fees auto-renew. Cancel anytime — access continues through the end of the billed period. No prorated refunds on partial-period cancellation.

7. Founding membership

Both Founding Viewer ($69.99) and Founding Creator ($49.99) are one-time, non-refundable, lifetime grants. Each tier hard-stops at 1,000 spots permanently. Sequence numbers are assigned atomically on payment confirmation and never reissued. Ad-free viewing under Founding Viewer survives any future platform pricing change.

8. AI-generated content

AI series are first-class on B/NG. Creators must disclose AI involvement at submission. Mismatched disclosure (an AI series declared as not-AI) is a strike offense. AI Series carries an audience tag — it is not banned, hidden, or downranked.

9. Music and voice-over

Licensed music must be backed by a receipt or rights record. Original music is encouraged. Royalty-free sources must be from a B/NG-recognized library — see Content Policy. Non-AI third-party voice-over triggers an auto-generated VO Talent Release stored in the encrypted Universal Legal Document Archive (BNG-21). Releases are legally binding once eSigned via the ANVX protocol.

10. Termination

We may suspend or terminate accounts that violate these Terms, the Content Policy, or applicable law. You may close your account at any time via /settings. Closed accounts retain a minimum legal records footprint for tax, payment, and compliance purposes — see the Privacy Policy.

11. Disputes

These Terms are governed by the laws of Delaware, USA. Any dispute is subject to binding arbitration administered by AAA in Wilmington, Delaware, except that either party may pursue claims in small-claims court where eligible.

12. Changes

Material changes are announced 30 days in advance via the platform notification system and the email on file. Continued use after the effective date constitutes acceptance.
